National Retail Properties Deploys Jatheon
To meet e-discovery compliance requirements

Florida-based National Retail Properties, a real estate investment trust (REIT), chose Jatheon’s Plug n Comply e-mail archiving appliance to address its concerns over the ever-growing rules around e-discovery compliance. "It was cumbersome to retrieve archived e-mails under our old system," explained National Retail Properties Vice President of Information Systems Dan Tervo. "We needed something smarter."
According to Kieron Dowling, president and CEO of Jatheon Technologies, "The real estate sector is dealing with a rising number of Supreme Court rulings concerning e-discovery, particularly over the past few months. These precedents, combined with the increasing interest we’re seeing in disaster recovery strategies, are spurring many real estate organizations to follow the lead of other public companies and adopt an in-house e-archiving solution."
Demand Heats Up for E-mail Archiving in the Real Estate Sector
It is now the law that electronic documents be shared in pre-trial discovery in federal court actions. Since the activities of real estate agents and brokers fall under the laws of the Federal Rules of Civil Procedure (FRCP), the U.S. Department of Housing and Urban Development (HUD), and other federal agencies, they cannot ignore this law.
As much as 70% of a company’s intellectual property is stored within the messaging system. E-mail is mission critical, and often e-mail servers are treated as corporate intelligence repositories – for which they were not designed. Recent research from the Radicati Group, Inc. states that the average corporate e-mail user sends and receives 133 e-mails a day, equating to 16.4 MB per day of storage. This number is expected to rise to 21.4 MB per user, per day by 2010.
After reviewing several archiving solutions – including one offered by their third-party e-mail hosting service – National Retail Properties selected the in-house Jatheon appliance. Citing an abundance of desired features, including on-site archiving capability, Tervo also stated affordability as a key deciding factor.
"Being a public company, a reliable compliance solution is very important to our productivity," said Tervo. "It’s been a ‘set it and forget it’ technology. It’s easy to find messages when we need to, and otherwise it’s just peace of mind knowing it’s there."
National Retail Properties joins Jatheon’s expanding list of real estate customers including Canadian company Teranet, an organization that maintains the fully digital registry of all land titles in the Province of Ontario.
