Date on Overland Patent Lawsuit Vs. BDT Extended

To January 12, 2012

Overland Storage announced that the International Trade Commission (ITC) has extended its initial final determination date on Overland’s patent infringement lawsuit against BDT Media Automation GmbH to January 12, 2012.

According to the Judges order, the extension was determined to be necessary as a result of an increase in the administrative and judicial duties of the judge, who was named Acting Chief Administrative Law Judge on August 4, 2011.

Overland filed a patent infringement lawsuit against BDT, IBM and Dell claiming infringement of two of its patents. An ITC trial was completed on September 7, 2011.

On November 16, 2011, Overland reported that the ITC action and district court action against IBM and Dell had been resolved by settlement. Overland’s infringement suit against BDT is ongoing and the company remains optimistic about the case.
