BDT Vs. Overland

German manufacturer retains Overland's co-founder as consulting expert.

Handal & Associates, lead counsel to BDT AG in defense of a pending International Trade Commission Investigation instituted by Overland Storage, Inc., has retained Robert Long, the sole Inventor of Record of U.S. Patent No. 6,328,766, as a consulting expert.

The ‘766 patent is one of the patents asserted against BDT by Overland. Mr. Long, a co-founder of Overland Data, has agreed to act as a consulting expert for BDT.

"It is unusual for an inventor to work in defense against a claim that his patent is being infringed," said Anton Handal, Esq., counsel for BDT. "Ordinarily, the first person retained by a plaintiff when initiating a patent infringement claim is the inventor of the patent. We believe that Overland’s claims are without merit and are pleased to have Mr. Robert Long working with us on this matter," Mr. Handal added.

The investigation was filed by Overland Storage, Inc. on October 19, 2010 in the International Trade Commission, and is scheduled to be heard in August 2011. In its complaint, Overland Storage, Inc. accused seven companies of infringing the ‘766 patent as well as its U.S. Patent No. 6,353,581. In November of 2010, the ITC initiated an investigation into Overland’s allegations that the sale of certain automated media library devices infringes these patents.
